Abstract经济法演生模式是经济法及其理论体系演化、演变及生成的逻辑基础。然而,人们对其传统理解和建构过于单一、西化,因而影响了现代经济法部门体系刷新的视阈。本文以我国当前正致力于建设的社会主义新农村为“标本”,指出了正值社会转型期,在传统农业社会秩序发生转变和重组这一过程中,经济法超越其传统演生模式,为社会主义新农村建设提供了其他传统部门法无力所及的法制供给,借此“标本”来管视和反思我国经济法传统主流演生模式,并对转型期中国经济法演生模式的新构建提出了一些看法。
Other AbstractThe formation mode of economic law is the logic basis of evolution, innovation and creation of econnomic law and its theoretical system. However, traditional understanding and construction of it is of a little simplicity and westernization, which affects the innovation of the system of the modern economic law sector. Taking our country's current construction of a new socialist countryside as specimens, this paper points out that, in the course of the change and restructure of the traditional agricultural order,which is just at the period of social transition, economic law beyond its traditional evolutionary mode, builds a new socialist countryside that other traditional sectors of the legal system are unable to supply. By the aid of the specimens, this paper reflects on economic law in mainstream mode of the China's tradition, and puts forward some of the views on the construction of the new evolutionary mode of economic law in transitional period.
