| Abstract | 本文主要针对当前在我国专利池许可中出现的滥用专利权行为，通过对国际条约、欧盟、美国、日本以及我国台湾地区在规制专利池许可中滥用专利权行为的成功经验的考察和借鉴，并结合我国目前在规制专利池许可中滥用专利权行为方面的现状及不足，然后提出了适合我国国情的立法建议和实施机制。 |
| Other Abstract | This article mainly aims at the current in our country patent pool licensing the patent abuses, through to the international treaty, the EU, the United States, Japan and Taiwan area of our country in the regulation of Patent Pool License of patent abuses of the successful experience and lessons, and unifies our country at present in the regulation of Patent Pool Licensing of patent abuse the right behavior in terms of the present situation and the insufficiency, and then put forward to fit our country national condition the legislative proposal and implementation mechanism. |
