Abstract

当前对住宅建设用地使用权续期问题争论的主要是“自动续期”问题。因为《物权法》等相关法律对此规定的很笼统,只是说明了住宅建设用地使用权期满后自动续期,而没有规定自动续期如何办理,自动续期是否有偿,自动续期的次数以及如何确定续期期限。本文着眼于当下的现状,从四个部分论述了住宅建设用地使用权到期后自动续期的法律问题。

第一部分首先从期限制度的层面给住宅建设用地使用权下了个定义,其次论述了住宅建设用地使用权的内涵,最后论述了我国住宅建设用地使用权形成的原因和意义。这为下文分析我国住宅建设用地使用权自动续期的现状以及解决对策奠定了理论基础。第二部分主要从五个层面论述了不足之处。首先论述了自动续期的适用范围不确定,其次对于自动续期是否有偿现行法律没有规定的现状,从当下的两种主流理论——无偿续期和有偿续期理论分别进行了论述。再次论述了我国的《物权法》《城市房地产管理法》,《暂行条例》对于自动续期的次数、条件、年限、费用的规定。最后两部分论述了自动续期是否需要重新订立出让合同规定不明,以及《城镇国有土地使用权出让和转让暂行条例》第40条的规定中地上建筑物无偿收归国有是对私有财产权的侵犯,有失公平。第三部分首先论述了香港、台湾、德国、日本的地上权期限制度以及各自的特点,其次论述了其中对我国住宅建设用地使用权续期制度值得借鉴的地方。第四部分从五个层面提出了解决建议。首先提出了我国住宅建设用地使用权续期制度完善应该坚持的原则,其次提出我国住宅建设用地使用权自动续期原则上应当有偿,最后针对自动续期办理的程序也提出了自己的建议。如果房屋所有权人不愿续期,未续期的地上物应当归属国家,国家应当补偿原房屋所有人,本文提出了补偿规则,并力求完善这一制度。

针对我国目前的住宅建设用地使用权续期一系列不足之处,国家应该尽早出台一系列配套法律法规去完善它,不能仅仅停留在当下模糊不确定的层面,相信在不久的将来我国也会拥有完备的住宅建设用地使用权期限制度。

Other Abstract

The current debate on the renewal of the right to use residential construction land is mainly "automatic renewal". Because the "Property Law" and other relevant laws of this provision is very general, but that the use of residential construction land after the expiration of the automatic renewal, and did not specify how to automatically renew, automatic renewal is paid, the number of automatic renewal and How to determine the renewal period. This paper focuses on the current situation, from four parts of the residential construction land use rights expired after the automatic renewal of the legal issues.

The first part first discusses the connotation of the use right of residential construction land from the perspective of the term system. Secondly, it discusses the reason and significance of the construction right of residential construction land in China. This provides the theoretical basis for the analysis of the status of the automatic renewal of the right to use residential construction land in China and the solution.The second part mainly discusses the shortcomings from five levels. Firstly, it discusses the uncertainty of the scope of automatic renewal. Secondly, it discusses the present situation of the existing laws which are not stipulated by the existing laws, whether from the current two mainstream theories - free renewal and paid renewal theory. The paper discusses the stipulation of the number of times, conditions, years and expenses of the "Real Estate Law", "Urban Real Estate Management Law" and "Provisional Regulations" for automatic renewal. The last two parts of the automatic renewal of the need to re-establish the contract to do the contract is unknown, and "urban state-owned land use right transfer and transfer of the Provisional Regulations," Article 40 of the provisions of the ground building free of charge is a violation of private property rights, Unfairly.The third part first discusses the land tenure system of Hong Kong, Taiwan, Germany and Japan, as well as their characteristics. Secondly, it discusses the areas where the renewal system of the right to use residential buildings in China is worth learning.The fourth part puts forward the solution from five levels. First of all, the paper puts forward the principle that the renewal system of the right to use land for residential construction in China should be adhered to. Secondly, it is put forward that the automatic right renewal of residential construction land should be paid in principle. Finally, the proposal of automatic renewal procedure is put forward. If the owner of the house does not wish to renew, the undeveloped land should belong to the state, the state should compensate the owner of the original house, this paper puts forward the compensation rules, and strive to improve the system.

In view of China's current residential construction land use rights to renew a series of shortcomings, the state should be introduced as soon as possible a series of supporting laws and regulations to improve it, not just stay in the current level of fuzzy uncertainty, I believe in the near future China will have Complete residential construction land use right period system.
