Abstract	农村宅基地及地上房屋的征收与补偿制度是我国土地制度的重要内容之一。本文共分为四个部分，通过介绍宅基地及地上房屋制度的历史，研究宅基地及地上房屋的产权，我国宅基地征收形成的根源等问题，以期找到解决我国农村宅基地及地上房屋征收问题的善道。第一部分：农村宅基地及地上房屋制度概述。首先通过农村宅基地上房屋征收概念的比较明确了农村宅基地征收的涵义。其次，讨论了农村宅基地上房屋征收特征作。再次，介绍了新中国成立后农村宅基地及地上房屋制度变迁。第二部分：我国农村宅基地上房屋征收制度形成的根源。首先，论述了我国农村宅基地上房屋征收制度形成的根源。其次，探讨了我国农村宅基地及地上房屋征收制度的作用与缺陷。第三部分：我国农村宅基地及地上房屋征收的补偿制度的现状。首先，对国家征收补偿的几种原则进行介绍。其次，分别讨论了国外和国内的宅基地与地上房屋征收的补偿原则和标准概况。最后，我国宅基地与地上房屋征收的补偿原则和标准存在的缺陷。第四部分：完善我国农村宅基地及地上房屋征收与补偿制度的建议。首先，说明了宅基地及地上房屋征收制度改革或完善的前提。其次，从改革宅基地上房屋征收补偿的标准，完善征收与补偿的程序。
Other Abstract	The system of the rural homestead and ground housing collection and compensation is the important content of China's land system. This paper introduces the history of the homestead and the floor housing systems, explore the homestead and on the ground housing the collection system to form the root of our collection and the status of the compensation system and the problems. The first part introduce the concept of the rural homestead and the floor housing systems.Firstly,the concept of rural homestead on the housing levy relatively clear meaning of the rural homestead levy. The second part introduce the formation of the root causes of rural homestead on the housing levy system. The third part introduce the Rural residential land and housing levy on the ground compensation system of the status . The main content of the fourth chapter is on how to improve the recommendations of the rural homestead and on the ground the housing collection and compensation system.
