Abstract食品是人类赖以生存和发展的最基本的物质条件,食品安全是人类赖以生存和延续的基础。2009年6月1日《中华人民共和国食品安全法》颁布施行,中国食品安全问题举国关注。但是近年来,食品安全事故仍然层出不穷,暴露出我国食品安全法律制度的完善上仍然有很大的空间。 香港特别行政区是世界上食品安全法律制度较为完善、食品安全事故发生较少的地区。香港作为世界上著名的自由贸易港,其食品大部分源于进口,其中绝大部分的食品由内地输入,面对来自世界各地纷繁复杂的进口食物,香港特别行政区政府经过不断地改革建立了较为完善的食品安全法律制度。内地与香港食品安全法律制度的比较虽然是在不同法域、体制存在差异的基础上进行比较,但香港的食品安全法律制度仍然有值得我们学习和借鉴的地方。国家可以通过法律实现对社会的控制,当然对具体的社会问题也可以实现有效的治理,在这个理论的基础之上,研究先进地区如何通过法律来治理食品安全问题,通过比较,我们可以吸取优秀的立法经验,促进我国食品安全法律制度的发展和完善。本文从制度要素的几个方面:制度的主体、对象、实体规则和程序规则,对内地与香港食品安全法进行比较,分析出内地食品安全法存在的问题,主要概况为以下几点:(1)食品安全监管不完善,主体划分欠科学,职能与责任不明确;(2)制度对象范围狭窄;(3)法律执行过程缺乏规范化和持续性;(4)法律法规处罚力度不够;(5)依赖行政规制而未上升到法治高度。
Other AbstractFood is the most basic material conditions for human survival and development, food security is the basis of human survival and continuation. June 1, 2009, the “Food Safety Law of the People's Republic of China” promulgated, China's food safety problem were paid nationwide attention. However, in recent years, food safety accident is still emerging, there is still a lot of space, exposed on the perfection of the legal system of China's food safety. The Hong Kong Special Administrative Region is a world relatively complete legal system of food safety, food safety accident less. Hong Kong as the world's most famous free trade port, most of its food derived from imports, which the vast majority of food imported from the Mainland, the face of the complex of imported food from around the world, the Government of the Hong Kong Special Administrative Region established a relatively reform improve the legal system of food safety. Comparison between the Mainland and Hong Kong legal system of food safety in different jurisdictions, institutional differences on the basis of comparison, but the legal system of food safety is still worth learning and reference. Country can achieve through the legal control of the society, of course, on specific social issues can also achieve effective governance, the basis of this theory, the study of how advanced areas the problem of food safety laws to govern, by comparison, we can draw excellent legislative experience, and promote the development and improvement of the legal system of China's food safety. From several aspects of the system elements: the system of the body, objects, procedural and substantive rules, comparison of the Mainland and Hong Kong Food Safety Law, the analysis of the problems of the Food Safety Law of the Mainland, the main overview for the following: (1) food inadequate safety supervision, The main divide owe science, functions and responsibilities are not clear; (2) a narrow range of system objects; (3) the lack of law enforcement process standardization and continuity; (4) laws and regulations is not enough punishment; (5) reliance on administrative the regulation not rise to the rule of law height.
