| Abstract | 行政补偿是现代法治国家极其重要的一项法律制度，对政府权力的规制和公民权利的保障至关重要。然而，由于我国行政法学的理论研究起步很晚，长期以来受整体主义和国家主义思潮的影响，我国行政补偿制度存在很多问题，立法相当滞后，相关的理论研究也极为薄弱。近年来在实践中因补偿引起的纠纷越来越多，但由于立法的滞后，一些问题处理比较的困难。所以对行政补偿问题的研究，无论在理论还是实践上，都具有一定的意义。
本文以保障公民财产权为切入点。围绕行政补偿这一中心问题，讨论了行政补偿制度的基本理论，分析了我国行政补偿的现状。探讨了我国建立行政补偿制度的基本思路，以期对我国的行政补偿制度的完善有所帮助。 |
| Other Abstract | Administrative recuperation is extremely important in the legal system of modern country governed by law , and it is essential to the structure of government's power and a guarantee of civil right . However, because the theoretical research of administrative law science of our country starts very late,being affected by wholism and national doctrine ideological trend for a long time, the administration of our country has a lot of questions to compensate, legislate quite lags behind, the relevant theoretical research is extremely weak too. There are more and more disputes arising from compensating in practice for recent years, but due to the lagging legislating, it is difficult to solve the problems. So compensation the research of the question to the administration has certain meanings both in practice and theory..
This dissertation regards ensuring citizen's proprietary as the breakthrough point. And around this point discuss the administration compensate basic theories of the system, analyzing the current situation of the administration of our country compensates. Excepting to probe into our country set up administration compensate basic thought of system, and be helpful to administration in our country compensate perfection. |
