面对当下严峻的反腐情势，在监察委员会职务犯罪调查中，充分运用电子数据是其职能履行的基本保障，然而，国家监察委员会刚成立，对于如何依法实现电子数据驱动的职务犯罪调查信息化尚处摸索阶段，亟待理论指引。这一研究目标的实现，须以电子数据及其在职务犯罪调查中运用时代价值的充分认知、我国有关职务犯罪调查中电子数据运用的法律法规遵从、前期检察机关作为职务犯罪侦查机关运用电子数据存在的问题及成因总结、国际社会有关职务犯罪侦查中运用电子数据的有益经验掌握等为条件。基于此，本文通过文献分析、规范分析和价值分析等研究方法的运用，经研究后提出，监察委员会职务犯罪调查中电子数据的运用，要加强电子数据的认识，构建“以信息引导调查”的侦查调查模式，完善与刑事诉讼制度衔接的法律，尽快完成与检察机关之间的转隶，并建立良性的人财物保障机制。

In the current tough anti-corruption situation, the full use of electronic data in the investigation of the crimes committed by the Commission is the basic guarantee for the performance of its functions. However, the State Supervision Commission has just been established, and it is still at the stage of exploring how to implement the electronic data-driven investigation of duty crime,which is in urgent need of theoretical guidance.  The realization of this research goal must be based on electronic data and its full recognition of the value of the times in the investigation of duty crimes, compliance with the laws and regulations governing the use of electronic data in China's relevant crime investigations, the existing problems and summary of the cause in the prosecution’s use of electronics as a duty crime investigation agency. The problems existing in the data and their causes are summarized as well as the international society’s beneficial experience in the use of electronic data in the investigation of duties and crimes. Based on this, with the help of research methods such as literature analysis, normative analysis, and value analysis. After the study, it is proposed that the use of electronic data in the investigation of the crimes committed by the inspection committee should strengthen the understanding of electronic data and build an “information-based investigation”. The investigative investigation model will improve the laws that link up with the criminal litigation system, complete the transition from the procuratorial organs as soon as possible, and establish a benign human and material security mechanism.
