| Abstract | 法院审理机动车事故或其他原因引起死亡的案件时，经常涉及死亡赔偿金的问题，尤其是受害人家庭得到死亡赔偿金后，家庭成员之间分配不公也会引发纠纷，产生案中案的现象。法院在处理这类案件时缺乏明确的法律依据，结果同类案件就会出现不同的判决结果，损害了司法的权威性和公信力，不利于保护家庭成员权益和维护家庭稳定，对死亡赔偿金相关案例的研究与讨论就显的有重要的意义和理论价值。过去由于法律规定比较模糊，死亡赔偿金的问题在理论界和司法实践中一直存在争议。有些法院把它看成是夫妻之间的共同财产处理，有些法院把它当做受害人的遗产处理，有时候连法官进行审理或调解也没有明确的法律标准。
通过对张某诉李某侵占死亡赔偿金案件的分析，可以为法院以后审理此类案件提供一些参考标准。理论方面，为立法、司法工作等方面对完善死亡赔偿金制度提出一些建设性的意见。 |
| Other Abstract | In judicial practice, cases of death due to traffic accidents and other accidents always occur, from which differences in distribution of the death compensation arise and in consequence leading to another case.For the Lack of unified standards in judicial operations, the similar case will have different results, which undermining the authority and credibility of the judicial justice and being not conducive to the protection of human rights and the social harmony and stability.Studies on the cases related to death compensation are of great value in theory and practice. For a long time, the legal provisions are not clear and the nature of death compensation has been debated in legal theory and judicial practice.Some courts think it is marital property, some courts think it is the property of the deceased, and so on. Even the judge doesn’t have a uniform legal basis for action.
In a practical sense, based on the “Zhang Sues Li for Encroaching Death Compensation” as an Example, In a theory sense, it puts forward some advices for perfecting death compensation system from the aspects of legislative, judicial and work system. |
