Abstract	随着科技的进步、媒体的发展，在大众知情权、媒体自由、公共利益的幌子下，侵犯公民隐私权案件的数量越来越多，公民的自由和隐私受到了越来越大的威胁和挑战。侵犯隐私权的方式呈现多样化，侵犯的客体逐渐复杂化。公民隐私权的保护面临诸多难题。本文从隐私权的基本定义和隐私权提出的背景着手，并结合侵权构成要件对杨丽娟案进行深入的分析。根据法院的判决在侵权四要件的基础上提出自己的观点，并对侵犯隐私权的预防和处理等方面进行了浅要的论述。本文分为四个部分：第一部分：案情及判决。介绍杨丽娟诉南方日报的案情及法院一、二审查明的事实、判决及争议焦点。第二部分：案件评析。从隐私权的定义着手结合侵权责任的构成要件，分析南方日报的报道是否构成侵犯杨丽娟及其家人的隐私权。第三部分：案件引发的思考。法院判决后，引起社会的强烈反响，社会大众对本案的看法和所持的观点各不相同。笔者结合现实情况从四个方面谈谈对案件的异议和思考。第四部分：媒体自由和隐私权保护的权衡。随着媒体自由的发展，如何保护隐私权，逐渐引起人们的重视。笔者结合社会的现实情况，并参考立法原意，提出浅显的看法和观点。
Other Abstract	With advances in technology, media development in the public right to information, media freedom, under the guise of public interest, the number of cases of violations of civil right to privacy more and more civil liberties and privacy has been a growing threat and Challenges. Diversified way of invasion of privacy, violation of the object became more complex. Privacy protections face many problems. In this paper, the basic definition of privacy and the privacy of the backgrounds to proceed, and with Elements of Yang Lijuan infringement case in-depth analysis. According to the Court in the infringement on the basis of four elements put forward their views, and invasion of privacy and other aspects of the prevention and treatment of the light to the discussion. This article is divided into four parts: Part I: the case and verdict. Yang Lijuan v. Southern Daily described the case and the court for a second trial of the established facts, the verdict and the focus of controversy. Part II: Analysis of the author of the case. Start from the definition of privacy tort liability with the composition of elements, analysis of whether the Nanfang Daily reported Yang Lijuan and their families constitute a violation of privacy. Part III: the case raised objections and thinking. After the court decision has aroused strong reaction of the public view of the case and the view is different. The author of four to talk about the reality of the case from the objections and China. Part IV: media freedom and privacy protection trade-off. With the development of freedom of the media, how to protect privacy, gradually attracted people's attention. The author combined with social realities, and with reference to legislative intent, made plain views and opinions.
