| Abstract | 近年来，新闻媒体迅猛发展，网络媒体、移动媒体等新兴媒体不断涌现，越来越多的公众人物和公众事件走入了我们的视野。这其中不乏有一些普通民众因相关新闻事件的报道而成为社会关注的焦点，从而成为公众人物。杨丽娟 就是此类公众人物的代表。在杨丽娟诉《南方周末》侵权案中，她被认定为 “自愿型公众人物”， 这是新闻侵权案件中首次采用“自愿型公众人物”的概念。作为特殊的社会群体，“自愿型公众人物”隐私权和名誉权的保护应该与普通民众有所区别。然而，我国现行法律之中并没有相关的专门性规定，学术界对这一问题的研究也存在诸多不足。面对如此现状，无论在理论还是实务界，“自愿型公众人物”隐私权和名誉权的保护都是一个有着重大意义的课题。本文以“杨丽娟案”这一典型案例为基础，对“自愿型公众人物”的认定及其隐私权的限制进行了重点研究。笔者希望通过本文的探讨，对我国未来公众人物相关制度的构建和完善有所裨益。 |
| Other Abstract | The recent years, the news media rapid development, the network media, the motion media and so on emerging media emerged unceasingly, more and more public figures and the public event has walked into our field of vision. Has some ordinary populace to become the focal point which many because of the related media event's report the society pays attention, thus becomes the public figure. Yang Lijuan is this kind of public figure's representative.
In Yang Lijuan sues "Southern Weekend" in the right infringement document, she was recognized that is “the voluntary public figure”, this is in the news right infringement case uses “the voluntary public figure” for the first time the concept. As the special social group, “the voluntary public figure” the right of privacy and the right of reputation protection should have the difference with the ordinary populace. However, in our country law has not been related the technicality stipulated that the academic circle also has many insufficiencies to this question's research. Facing so present situation, regardless in the theory or the practical realm, “the voluntary public figure” the right of privacy and the right of reputation protection is one has the great significance topic.
This article take “The case of Yang Lijuan” this illustrative case as a foundation, right “voluntary public figure” recognizing and the right of privacy limit has conducted the key research. The author hoped that through this article discussion, the public figures will be related in the future to our country the system the construction and the consummation has a benefit. |
