Abstract   随着网络信息技术和产业的迅速发展,特别是网络原创小说飞速发展,续写作品这一文学现象也引发了层出不穷的法律纠纷。正是因此,续写作品才引起了很多学者的注意。由于我国现行的著作权法中并没有对续写作品及行为做出明确规定,学者们在续写是否是侵权行为的讨论中也没有达成共识。因此,本文认为探究续写作品的著作权问题对我国著作权制度的发展和完善具有重要意义。    本文正文共分为四部分。第一部分是引言,通过全国首例网络反垄断纠纷案的争议焦点,引出中心问题,即续写他人作品是否构成侵权。    第二部分对续写作品的概念、类型和特征进行归纳总结。通过对现有学者观点的解析,提出自己的观点。本章重点讨论续写作品的特征,这也是学界争论较多的问题。本文认为续写作品具有对原作品的依附性和反作用性,同时续写作品还具有利益性和独创性。独创性是续写作品的本质属性。续写作品是作者依靠自己的思维独立创作的作品,具有独创性的特征,而这一特征符合著作权法的要求。著作权法并不要求受保护的作品是首创的,而只要求它是独创的。 第三部分是对续写作品的侵权性与相关著作权问题的分析。续写行为并没有直接在原作上施加任何形式的改动、歪曲、篡改,故续写作品侵犯原作的保护作品完整权的说法是欠妥当的。作品名称本身不是作品,不能作为一件独立的作品受著作权法保护,只有当其作为作品不可分割的一部分时才和作品一起受到著作权法的保护。作品名称的著作权法保护通常可通过主张保护作品整体的著作权来得以实现。续写作品并不具备演绎作品的性质,所以续写作品并不侵犯作品的演绎权。续写作品在性质上虽然是属于合理使用,但这种合理使用也是受到了一定限制的。我们在致力于保护原作者的权利的同时要在原作者和续作者之间找到一个平衡,这样才可以既很好的保护原作品著作权人的利益,又要给写作者和社会公众一个广阔的使用空间。 第四部分是对构建续写权制度的立法建议。首先论述构建续写权的必要性,然后提出构建续写权制度的建议。为了平衡续写者与原作者之间的利益,应该对续写权进行必要的限制。
Other Abstract  With the rapid development of the net information technology and industry, especially arise of internet literature. Continuous writing led to the endless stream of legal disputes. Therefore, so many scholars began to pay attention to continuous writing. Because there are no clear regulations about continuous writing in the current copyright law, there is no common agreement on whether continuous writing is tortuous among scholars. Therefore this paper argues that the continuous writing copyright issue to explore the development of our copyright system and improvement of great significance.   This article is divided into four parts. The first part is the introduction, through the controversial focus of the first network antitrust case, leads to the central question, namely written works of others will constitute a tort. The second part is the summary of concept, types and features of continuous writing. Through the analysis on the existing viewpoints of scholars, put forward author’s own point of view. This chapter focuses on the characteristics of continuous writing, which is where the academic divergence. This paper argues that the writing works with the dependence of the original work and counterproductive, and at the same time continue to write works also has interests and originality. Originality is an essential attribute of the writing work. Writing works of relying on their own thinking independently created works with ingenious features, this feature is in line with the requirements of the Copyright Law. The copyright law does not require a protected work is the first, but only requires that it is original. The third part is analysis on infringement and copyright issues of writing works .Continuous writing does not have any direct change, distortion and falsification on original work ,so it is impossible that it infringe the completeness protection right. The title itself is not work. It can’t be protected by the copyright law as an independent work, unless it is a inquisition part of the work. Title of the copyright laws is usually available through advocate’s protection of the copyright of the work as a whole to be realized. Continuous writing does not have the nature of interpretation work, so it won’t infringe the right of interpretation. Continuous writing belongs to Fair Use which is restricted by rules.
