| Abstract | 随着旅游市场的日渐繁荣，旅游纠纷也随之增多，由于我国目前还没有一部完整的旅游立法，对于因旅游而产生的一系列纠纷还无法给予更全面的保护。 自费游项目也越来越多，当旅游者参加这些自费游项目发生侵权时，存在着一个旅游中第三方侵权的问题，在这种侵权行为中，该如何使用法律来保护旅游中各方的利益，是本文值得讨论的问题。
本文 分析归纳出“旅游第三方侵权”纠纷所争论的焦点问题：自费游中旅游各方法律关系的界定，旅行社安全保障义务的法律界定和义务范围，侵权责任中各方的责任分担及归责原则的适用等法律问题。
本文旨在通过分析“旅游第三方侵权”的相关案例 ，提出“第三方侵权”纠纷争议的焦点问题，并对焦点问题进行研究分析，最后对实践中如何规范“旅游第三方侵权”提出建议。 |
