Abstract随着信息技术的迅猛发展,新闻媒体行业也迎来了一个崭新的时代。广播媒体、电视媒体、网络媒体等多种现代媒介形式应运而生,这极大的推动了我国社会主义建设的文明程度。但是,新闻媒体之间的竞争也更加激烈,个别媒体为了自身的利益,炮制虚假新闻因而触犯损害商业信誉罪的案件时有发生。实践中,对于媒体损害商业信誉案的处理一直争议不断,一些相似的行为,有的被科以刑法,有的却只构成民事侵权,加上媒体的特殊性,这类犯罪越来越引起学者们的关注。因此,完善损害商业信誉罪的相关规定十分重要。 本文结合2013年度受到媒体广泛关注的“陈永洲损害商业信誉案”,以这一典型案例为基础,对新闻媒体损害商业信誉犯罪中存在的疑难、有争议的问题进行了研究。全文共分为三个部分:首先,笔者对“陈永洲案”作了简单的案情介绍,针对控辩双方的观点,归纳了本案的争议焦点,主要涉及行为的认定,主观方面的分析,单位犯罪几个方面的争论。然后,根据刑法中对损害商业信誉犯罪的规定,以及理论界的观点,从立法、司法的角度对以上焦点进行了分析,得出新闻媒体以散布的行为方式可以构成损害商业信誉罪,本罪的主观方面包括间接故意的结论,判断了本案陈永洲的行为构成损害商业信誉罪。最后,针对新闻媒体损害商业信誉犯罪的一些特点,分析了司法实践中损害商业信誉犯罪案件的难点,提出了自己的建议。 笔者希望通过本文的探讨,对未来关于本罪相关规定的完善有所裨益。
Other AbstractWith the rapid development of information technology, the news media industry has also ushered in a new era. Broadcast media, television media, network media and other forms of modern media came into being, which greatly promoted the civilization of China's socialist construction. However, the competition between the news media is more intense, the individual media for their own interests, and the processing of false news and thus the crime of damaging the commercial reputation of the crime has occurred. In practice, the media damage the credibility of the business case for the treatment is controversial, some similar behavior, and some were, in criminal law, but some only constitute a tort, and the particularity of media, this kind of crime and attracted the attention of scholars. Therefore, to improve the relevant provisions of the crime of damaging the commercial reputation is very important. Combined with the year 2013 received widespread media attention, "the case of Chen Yongzhou” damage to business reputation, based on the typical case, has conducted the research to the news media to damage the business reputation of crime difficult and controversial issues. The full text is divided into three parts: first of all, the author simply introduces the case of “Chen Yongzhou” , for both the prosecution and the defense point of view, the focus of controversy in this case are summarized, mainly related to the behavior of cognizance, subjective analysis, unit crime debate. Then according to the provisions to damage the business reputation of a crime in criminal law, as well as the theory point of view, from the legislative and judicial point of view on these points are analyzed, obtains the news media to spread behavior can constitute the crime of damaging business credit, the subjective aspect of the crime include indirect intentional conclusion, judge the Chen Yongzhou in this case acts constitute damage the business reputation of a crime. Finally, according to the characteristics of the commercial credit crime of the news media damage, this analysis of the judicial practice of the crime of commercial credit, the difficulty of the crime cases, put forward their own proposals. I hope that through this study, to improve the relevant provisions of the future benefit.
