| Abstract | 对于侵犯消费者知情权的案件其争议的焦点往往就在于被告是否侵犯了原告的知情权。根据消费者权益保护法第十九条的规定经营者有着告知义务，另一方面第八条规定了消费者知情权的内容，但从两个条文的内容及表述来看，有关经营者义务的表述既缺乏引述性的规定，又缺乏有关满足与保护消费者知情权的宗旨揭示与一般性条款，从而不利于消费者知情权的落实。
本文选择三个与消费者知情权紧密相关的案例予以介绍，三起性质相同、结果却不尽相同的案件，其争议的焦点均在于是否侵犯了消费者的知情权。在文章的第二章节以消费者权益保护法中对消费者知情权与经营者告知义务的规定为依据，分别详细地论述了消费者知情权及经营者告知义务的一般理论及其存在的问题。在文章的第三章节对侵犯消费者知情权案件不断发生的原因进行了探究，对我国现行法律关于消费者知情权所做的规定进行了解读并对司法实践中法官如何认定消费者知情权的客体范围提出了一定建议，以及对于侵犯消费者知情权的行为应当给予何种处罚进行了阐述。在文章的最后一个章节，在本文前面论述的基础上，提出了如何理性对待消费者知情权。 |
