| Abstract | 随着中国经济的飞速发展，居民的消费水平也日益提高。在消费生活中，往往会遇到各种形式的侵犯消费者权益的行为。居民对于这种情况的处理也是各式各样，有的人懂得利用法律的武器维护自身的合法权益，有的人只能咽下那口气。在立法方面我国于1993年颁布了《中华人民共和国消费者权益保护法》，第一次以立法的形式全面确认消费者的权利。在现有的法律制度下消费者应当具有自我保护意识、权利意识、文明消费意识、消费者群体保护意识。
消费者权益是关系到社会每一个人的权益，消费者权益的保护是不可忽视的，否则，市场经济的发展也会受阻。随着国家宪政的完善、经济的发展、市场的繁荣，对不法经营者侵害消费权益的惩罚将更加法制化、制度化，消费者的维权意识将不断提高，维权途径将会更多，更高效。这些都是社会主义市场经济秩序健康发展的必然要求所在。为了让自己的权益不受损，就应该拿起法律武器，运用我们享有的权利，对于构建和谐社会和法治社会都是具有重要意义的。
本课题以哈尔滨市及所属县的消费者为主要调查对象，包括高校学生、公务员、企事业单位员工、农民工、农民、个体工商户。共发放问卷615份，回收问卷605份，回收率为97.6%，有效问卷600份，有效率为97.6%。问卷通过28个客观题和2个主观题，分别从基本情况、对消费法律的认知情况、法律服从及运用、消费维权意识、法律期待和评价五个方面进行调查。笔者运用SPSS统计软件进行数据分析。
在对哈尔滨市民消费维权意识的特点及生成原因分析中，笔者从加强消费者维权意识教育，提高消费者维权意识；强化法治文化建设，营造法治氛围；加强消费立法力度的层次对提高消费维权及更好的消费方面提出对策。 |
| Other Abstract | With China's rapid economic development, people's consumption levels are rising. In the consumer life, Residents tend to encounter various forms of violation of consumer of rights and interests . Residents’ the handling of this case is also a wide range, and some people know how to use legal weapons to safeguard their own legitimate rights and interests, and some people can only bear it. On the legislative front in 1993, China promulgated the "The People's Republic of China Consumer Protection Law", the first legislation in the form of full recognition of the rights of consumers . In the existing legal system consumers should have a self-protection awareness, rights awareness, civilized consumer awareness, consumer groups protection awareness.
The interests of consumers are related to the interests of everyone in the community, protection of the rights of consumers can not be ignored, otherwise, the market economic development will be hindered. With the constitutional perfect、economic development、the prosperity of the market ,the penalties to unscrupulous operators for violations of consumer rights will be more legalized, institutionalized, consumers’ awareness of rights protection will continue to increase, there will be more means of protection and the protection will be more efficient. These are the necessary requirement for the healthy development of socialist market economic order . Consumers should take up legal arms and use our rights to protect their benefits against illegal damages which are of great significance for building a harmonious society and the rule of law. The topic of this article takes the residents of the city of Harbin Harbin and its district as the main subject of investigation, Including university students, civil servants, enterprises employees, migrant workers, farmers, individual businesses. A total of 615 questionnaires were issued, 605 questionnaires were recovered, the recovery rate was 97.6%, 600 valid questionnaires, efficiency of 97.6%. The questionnaire by 28 objective questions and 2 subjective questions respectively, covering the basic situation of consumers、awareness of the law、consumers’ obeing and using of law、consumer rights protection awareness, their expectations and evaluation of law. The author used the SPSS statistical software for data analysis.
