Abstract	矿产资源是人类社会存在和发展的重要物质基础，对国家经济发展具有重要意义。各国对此予以高度重视，一般都拥有发达的矿产资源法律制度。矿产资源物权制度是促进矿产资源高效利用，完善矿产资源保护，明晰矿产资源产权反映于法律制度上的必然结果。矿产资源具有“物”的特征，可以成为物权的客体。我国的矿产资源物权制度不健全，存在诸多缺陷，导致矿产资源所有者的权益无法体现，矿业权人的利益缺乏保障，矿产资源担保制度缺失等问题。本文以此为背景，结合我们国家实施不久的《物权法》来分析和探讨矿产资源物权法律制度的基本问题。本文在写作体系上遵循了传统物权法的基本架构，以矿产资源所有权、矿产资源用益物权（矿业权）和矿产资源担保物权为重点进行了分析。文章结合物权法基本理论，对将矿产资源纳入到物权法范畴进行研究可能存在的问题及对策进行了深入探讨。文章共分六部分，分别为绪论、矿产资源物权制度的基本属性、矿产资源物权制度之矿产资源所有权、矿产资源物权制度之矿产资源用益物权、矿产资源物权制度之矿产资源担保物权和结论。
Other Abstract	Mineral resource is an important material basis for the existence and development of human society.Almost every country pays serious attention to mineral resource and makes every endeavor to perfect the legislation of it.The real right of mineral resource is the essential result of promoting the efficient use of mineral resources, improving the protection of mineral resources and clearing property rights of mineral resources.Mineral resources have the feature of “objects”,so it can become the object of property.This paper follows the pattern which the traditional real law initiated ,emphasize the analysis of the ownership of mineral resource, usufruct of mineral resource and the security interest of mineral resource.In combination with the basic theory of the mineral resource law,this paper makes a thorough exploration of the mineral resource right in the field of real law.There are six sections of this paper,including introduction,the basic properties of the mineral resource law,the ownership of mineral resource,usufruct of mineral resource ,the security interest of mineral resource and the conclusion.
