改革开放后,中小企业成为国民经济发展的重要力量，在解决就业、增加国民收入、促进经济发展等方面做出了巨大贡献。但是，随着互联网经济的发展和我国社会转型的有序推进，中小企业民间融资法律监管问题日益突出，相关的法律规制不健全，配套政策没有有序跟进，影响了中小企业的进一步发展。

鉴于我国中小企业民间融资法律监管面临的诸多法律问题，本文通过文献研究和比较研究的方法，提出问题、分析问题、解决问题，借鉴域外国家的经验，弃其糟粕取其精华，对我国中小企业民间融资法律监管问题进行研究，从中发现我国和域外国家在中小企业民间融资法律监管问题解决方面的差异，从而更好的为我国的中小企业民间融资法律监管提供有益指导和借鉴。我国中小企业民间融资法律监管存在监管专门法律空白、法律监管主体多头缺乏协调性、缺乏具体监管内容、监管保障制度不健全、监管执法力度不够等监管法律问题。建议从确定中小企业民间融资法律监管的基本原则，完善中小企业民间融资法律监管具体对策两个主要方面，解决中小企业民间融资法律监管问题，完善中小企业民间融资法律监管的相关立法，助力于解决目前我国实体经济发展低迷的困局，使中小企业为我国经济转型升级和社会发展做出更大贡献。

After the reform and opening up, small and medium-sized enterprises have become an important force in the development of the national economy, increasing national income, promoting economic development and made great contributions. However, with the development of the Internet economy and social transformation of our country in order to promote the legal supervision, private financing problem of small and medium-sized enterprises have become increasingly prominent, relevant legal regulation is not perfect, the supporting policies can not be ordered to follow up, affected the further development of small and medium-sized enterprises.

In view of the many legal problems of legal supervision of China's financing of small and medium sized enterprises, through the use of law and management principle, the author puts forward some problems, and analysis ideas and solve problems. Through the comparative analysis method, the experience of extraterritorial countries, from discard the dross and select the essence, to study the legal supervision of private financing of small and medium-sized enterprises in China, from China and other countries found in private financing legal supervision of small and medium-sized enterprises to solve the differences, so as to better serve the legal supervision in China the financing of small and medium-sized enterprises to provide useful guidance and reference. It is found that in small and medium-sized enterprises of our country folk financing legal supervision supervision special legal supervision body long legal gaps, lack of coordination, lack of supervision content, specific safeguard mechanism is not perfect, lack of supervision and law enforcement of legal supervision. Suggestions from the basic principles of the determination of legal supervision of private financing for small and medium-sized enterprises, improve two aspects of specific countermeasures of legal supervision of private financing for small and medium-sized enterprises, to solve the legal supervision of private financing for small and medium-sized enterprises, improve the relevant legislation of legal supervision of private financing for small and medium-sized enterprises, help to solve the current development of the real economy downturn predicament, let the small and medium-sized enterprises make a greater contribution to China's economic transformation and social development.
