| Abstract | 遗嘱信托制度作为信托制度中极其重要的一个部分，从它出现开始就一直有着财产管理和财产转移的功能。后期又发展成为一种在部分国家常用来避税的一种措施。遗嘱信托制度作为一种充分尊重被继承人个人意志自由，可以有效的避免被继承人去世后其遗产继承出现纠纷，以及由于子孙后代过度的挥霍导致的严重后果。逐渐的从英美法系的国家，被一些大陆法系的国家借鉴，成为其国家民众继承制度的有效补充，是保持社会稳定的新举措。
在经济飞速发展的今天，个人财富的急剧累加对传统的遗产继承制度发起了严峻挑战。由于个人所有资产的不断增加关于遗产纠纷也呈现出飞速增长的趋势。我国是一个兼容并蓄的国家，因此国外关于遗产管理的另外一种形式遗嘱信托恰好弥补了这一空缺。经过一段时间的发展，其立法状况不太乐观。导致这种制度在我国的生存土壤天然匮乏。为了完善我国的遗嘱信托制度，本文主要从以下几个方面进行了探讨，首先探寻了遗嘱信托制度的起源，并对遗嘱信托制度在其他国家的运行进行了简单介绍。其次对我国目前对遗嘱信托制度的研究进行总结归纳，进一步发现现行制度的不完善之处。结合自身的研究和相关调查给出自己的几点意见。 |
| Other Abstract | Testamentary trust system as a trust system and an important part of his emergence from the beginning, it has always been a transfer of property and property management functions. Gradually from the state common law, civil law is learn from some countries to become an effective complement to their national public inheritance system is the heart of initiatives to maintain social stability.
In today's rapid economic development , the rapid accumulation of personal wealth on the traditional system of inheritance launched a challenge. Under the increasingly grim legacy of disputes handled in the traditional heritage of the drawbacks of revealing more and more , how effective management and planning seemed imminent. For medical advice the trust system " Trust Law" only gives principled notes, and between multiple aspects of the existing legal provisions and the existence of a conflict , such as " Inheritance Law " on the entry into force of wills and inheritance " reserved share." Combine their studies and related investigations give their observations. |
