| Abstract | 环境资源物权制度是环境法学研究中的一个新课题。但我国学术界还只是刚刚开始涉及这一领域，对很多问题都没有展开讨论。所以，本文只是一个初步尝试，希望能够抛砖引玉。
首先，本文将物权制度引入环境法领域的必要性进行概述。西部保持良好的生态环境是西部乃至全国经济发展的前提，实施西部大开发战略，首先要进行生态环境建设的建设。但是，由于长期对西部生态系统的掠夺性开发以及环境产权、资源价格、外部性等方面的因素，导致西部地区严重而突出的环境问题。环境资源物权制度适应可持续发展的需要，可以用来解决西部的环境问题。
其次，本文详细论述环境资源物权制度的具体内容。西部开发的过程，也是法律生态化的过程；将大开发活动纳入生态法制的轨道，尤其资源环境的使用、收益方面引入相关的资源环境物权制度，以制度创新促进生态环境建设。环境资源物权包括环境容量权、环境资源相邻权、自然资源权。
最后，本文提出建立环境资源物权救济途径。在西部资源环境物权制度建设中，还要建立环境物权的救济途径，保障权利人权利的实现，以最终达到建设良好生态环境的目的。 |
| Other Abstract | The system of environmental resources property system is an specially important topic in science of enviroment law. However, Chinese scholars have just begun to study it. Up to now, no one has made a detailed and systematic study of it. I attempt to research it and hope that I cast a brick to attract jade.
About all, it is a important part of the modernization strategy in China to carry out the plan of Western Development and to build up the legal system of ecological eviroment. But the severe and conspicuous environment problems have resulted from the violation of enviroment property right, price of resources and externality ect. Therefore, regine of real right applied in environmental law is necessary.
Secondly, the process of Western Development is the process of biological law. Legality is indispensable to western Development in which the developing action and environment protection should consistently be applied in profit and use of environment resources.We should adhere to the principle of national macro-regulation and macro-control and should lay equal stress on the principle of ecological results and econmic results in order to ensure a sustainable development.
At last, The system of environment property right should include legal system building of real right relief in order to ensure right holder real right. |
