| Abstract | 随着科技的进步与互联网的迅猛发展，网络域名逐渐成为新的重要资源，但网络域名在给人们带来巨大利益的同时，也引起了诸多问题。然而我国有关网络域名的立法却存在不足甚至缺失，使得网络域名管理成为难题。
而随着网络域名的发展，针对其展开的交易和服务也渐渐兴起，由于这些业务在传统业务的形式和特点之外，更具有一定的特殊性，因此无法完全适用传统业务的法律法规，甚至在某些问题上存在法律规制的空缺与矛盾，不利于网络域名资源的合理利用与网络管理的良性运行。
本篇论文主要分为四部分，包括：第一部分对网络域名进行概述，对网络域名及域名权的性质进行法律界定；第二部分分析我国网络域名立法与实践中存在的主要问题，并展开讨论网络域名业务中可能存在的法律问题，在此基础之上探析对其进行法律规制与保护的必要性；第三部分主要分析各国及国际组织的相关立法，并根据我国实情，提出可借鉴之处；第四部分则针对第二部分的分析结果，借鉴第三部分国外相关立法经验，结合我国司法实践与实际国情，提出法律建议，因此该部分为本篇论文的重点研究部分。 |
| Other Abstract | With the rapid advancement of technology and the Internet, the network name is becoming an important new resource. But the network domain name to bring great benefits, but also caused a lot of problems. However, our legislation on network domain but there is insufficient or absent, making the network domain management becomes a problem.
With the development of Internet domain names for its trading and services expanded gradually rise, because of these business forms and characteristics in addition to traditional business, but also has some particularity, and therefore can not be completely applicable laws and regulations of traditional business, even Vacancies exist and contradictions legal regulation on certain issues, is not conducive to the healthy operation of the network domain rational use of resources and network management.
This thesis is divided into four parts, including: the first part of the network domain overview of the nature of the Internet domain names and domain name rights were legal definition; the second part analyzes the main problems of the Internet domain name exists in legislation and practice, and discussion legal issues that may exist in the network domain name business, on this basis of the need for legal regulation and protection of them; the third part analyzes the relevant legislation countries and international organizations, and according to our facts presented can learn from ; The fourth part analyzes the results for the second part of the third part of the relevant legislation learn from foreign experience, combined with the actual conditions of China''''s judicial practice, legal recommendations and therefore focus on part of the part of the paper. |
