| Abstract | 伴随着生命科技的飞速发展，器官移植手术在临床医学领域获得了爆发性发展，问题随之而来，那就是中国可供移植的器官数量产生了很大的缺口。然而，我国的尸体器官捐献率很低，远远满足不了临床需求。尸体器官捐献是社会伦理、道德、法律和传统文化激烈交锋的领域，本文从法律视角进行研究，以期能为我国尸体器官捐献提供有益的法律对策。
笔者首先考察了尸体器官的定义和范畴，确定了本文采用的尸体器官范畴，明确了尸体器官捐献的法律性质。然后，笔者梳理了中国尸体器官捐献的现状，发现中国尸体器官捐献的现有法律制度并不完善。最后，笔者考察了域外某些代表国家和地区的有关尸体器官捐献的法律成果。在此基础上，提出了若干有益于我国尸体器官捐献的法律对策。
笔者对中国尸体器官捐献率低的困境，从法律角度提出了三大对策。第一个法律对策是完善中国尸体器官捐献法律的立法对策。第二个法律对策是构建我国尸体器官捐献的法律制度，建议采用家庭同意制度、合理的脑死亡标准制度和医院通报制度。第三个法律对策是构建我国尸体器官捐献法律的辅助制度，在相关法律中纳入物质补偿制度、非物质激励制度和公众教育制度。

| Other Abstract | With the development of life science and technology, organ transplant operation develop rapidly in medical clinical field, but a problem also comes out, which is the number of the organ for transplanting is not enough for the need of clinic, it causes a big gap between them. The best way of gaining the organs is from the donation organs of people after their dead, which is called gaining donation of corpse organs academically. But, the rate of the donation of our nation’s corpse organ is pretty low, which cannot satisfy the clinical needs. The donation of corpse organ is a fierce battle field among social ethics, morality, law and traditional culture. This paper will do some study in legal point to hope that it can provide some countermeasures for organ donation.
I firstly study the basic concept and scope of corpse organ by using contrastive way, and determine to use the general scope. Then by using historical way, I will analysis the current situation of the donation of corpse organ and know that the rate of donation of corpse organ is far away below some nations, and the legal system of the donation of our nation’s corpse organ is not perfect. On the basic of the research of documents, I review the legal achievement of some representative nations. With the study above, I will propose some helpful legal countermeasures for the donation of corpse organ by combining local culture.
I propose three legal countermeasures for helping the donation of corpse organ. The first one is to perfect the legal strategy of the donation of corpse organ in the future of our country ,give the concept of public welfare legislation of the donation of corpse organ ,adopt the legal separate mode, build and perfect organization system of the donation of corpse organ and transplant .The second one is to build legal system of the donation of corpse organ ,I want to give a suggestion that we can adopt the family permitting system ,reasonable standard system of brain death ,and the system of hospital notice .The third one is to build the supporting legal system for our nation’s the donation of corpse organ ,which are mainly material compensation system ,non-material excitation system and public education system.
